Please read our Terms and Conditions (“the Terms”) carefully before booking classes. All services supplied by YOGA 108. (Registered address: Two Jays, Cavell Road, Billericay, CM11 2HS), are subject to the following Terms and Conditions.
Please read these Terms & Conditions prior to booking ANY service offered by YOGA 108. By booking, you are confirming that you have read these terms and agree to & are bound by these said terms & conditions. These Terms together with the items listed below, constitute a contract of membership between you (the client) and us (YOGA 108).
In these Terms “we”/”us”/ “our” / “YOGA 108” / “Y108” means YOGA 108. And “you”/ ”your” / ”yours” means you, the direct client. In these Terms, “class” or “classes” may refer to any and all services offered by YOGA 108.
1. SPECIAL LIMITATION OF LIABILITY – CORONAVIRUS/COVID-19 PANDEMIC
Due to the impact of COVID-19 and the long-term social distancing measures in place which will drastically affect for our industry, Wellness 108 Ltd. and the studio in 9 The Walk has been permanently closed. Any membership that were purchased prior to lockdown can be used for any class & workshop provided by Yoga 108 up until 31st December 2021.
From September 2020, Yoga 108 will be running online sessionsand regular workshops & events in Billericay, as well as face to face classes, workshops & events in the New England area covering North West Essex, South West Suffolk and South East Cambridgeshire.
Yoga 108 takes the coronavirus pandemic very seriously and has put in place measures to help reduce the spread of COVID-19. However, Yoga 108 cannot guarantee that you, your family, or your guests will not become infected with COVID-19 when attending any service provided by Yoga 108. It is possible that attending classes, events and activities with Yoga 108 may place you in close physical contact with other attendees and teachers which could increase the risk that you, your family members, and/or your guests contract COVID-19.
These acknowledge the contagious nature of COVID-19 and voluntarily assume the risk that you, your family members and/or your guests may be exposed to or infected by COVID-19 at any location that Yoga 108 provides services at and that such exposure or infection could result in personal injury, illness, permanent disability, and death.
You understand the risk of becoming exposed to or infected by COVID-19 at any location that Yoga 108 provides services at which may result from the actions, omissions, or negligence of yourself or others, including, but not limited to, Yoga 108 employees, members, and attendees.
By enrolling online, and/or attending in person classes, events, activities and any other services and/or entering any facility used by Yoga 108 to provide classes, events & activities and using any equipment, you voluntarily agree, on behalf of yourself, your heirs, personal representatives and/or assigns, and any person or minor child you may enrol:
(a) to assume all of the foregoing risks and accept sole responsibility for any injury, illness, damage, loss, claim, liability, or expense, of any kind (including, but not limited to, personal injury, disability, and death) that may occur to you or your family members in connection with attendance at Yoga 108 or as a result of participation in Yoga 108 services (“Claims”);
(b) covenant not to sue, Yoga 108, its teachers, clients, and employees, and service/premises providers from the Claims, including all liabilities, claims, actions, damages, costs or expenses of any kind arising out of or relating thereto, based on the actions, omissions, or negligence of Yoga 108, its teachers, students, attendees, and employees, whether a COVID-19 infection occurs before, during, or after attending a location and its facilities used by Yoga 108 or participating in any Yoga 108 service.

Please consider, when purchasing your membership, that we do offer a slightly reduced timetable and classes can be subject to cancellation during the holiday seasons.
Services provided by Yoga 108 are open to everyone at any location. We ask that you only attend a facility used by Yoga 108 to provide classes, events if you feel well. If you are unwell or showing any symptoms of Coronavirus, please do not attend any session provided by Yoga 108.
Class sizes kept to a minimum of 15 in Steeple Bumstead & Helions Bumstead AND 12 in Adiago to allow for 2 meters distance between mats.
To further minimise risk of COVID-19 transmission and to adhere to Government restrictions, all yoga sessions must be pre-paid & pre-booked via www.yoga108.uk. Prices are as stated on www.yoga108.uk and may change from time to time, but all bookings made prior to change in price will remain unaffected. Please ensure you have the correct payment option ONLINE, OUTDOOR OR FACE TO FACE options.
To further minimise risk of COVID-19 transmission and to adhere to Government restrictions, all yoga sessions must be pre-paid & pre-booked via www.yoga108.uk. However, should you require assistance with booking, please contact Nathalie directly via email@example.com or 07863 544 537.
Please note, our new cancellation policy – if you cancel with less than 24 hours prior to a face to face session you’ll lose your class pass. We’ve put this in place because we’ve a limited number of spots and we want to be able to offer the unused space to someone else.
All classes are offered by Yoga 108 subject to availability. Yoga 108 does not guarantee availability at any time.
3. ONLINE YOGA SESSIONS
The cost of each class/course/workshop is shown clearly on the website.
All online classes must be pre-booked and paid for in advance on our website or via the GOTEAMUP app.
It is your responsibility to ensure that you have made your booking and submitted payment correctly.
If you have a 4 class in 4 week membership or single class pass, online booking automatically deducts a class from the pack.
If you have an unlimited monthly membership, all classes included in your chosen membership type will have no cost attributed to them.
Additional classes /workshops / courses must be paid for at the time of booking.
3.1 ONLINE SERVICES HEALTH & SAFETY
Please join your online session at least 5 minutes prior to your session. If you do join late, please ensure your microphone is muted so as not to disrupt the class.
For anyone participating in any of our online services, you do so at your own risk, including our live-stream Zoom classes and any recordings.
You take full responsibility for your health and safety, including any injuries and you accept responsibility to inform the teacher of any medical changes.
Yoga 108’s services are for adults only unless the service is clearly stipulated for young people or families (for these services, it is the parent / guardian’s responsibility to ensure the safe participation of people under 18 (please also see section kids & teens below).
Please avoid attending online sessions if you’re in doubt as to you ability to carry out the instructions safely.
Please note the live-stream classes are recorded and may be available on-demand afterward, which may mean you are included within the recording.
We require you to:
Use a suitable, non-slip floor space and any potential obstructions in the vicinity are removed before you participate;
To avoid activities if you have, or suspect you may have, any current health concerns, injuries, aches and pains;
Inform the teacher at the start of the class if you have; any injuries, health concerns or conditions which affect your mobility or are likely to cause you concern when doing the session / class; high blood pressure; low blood pressure/fainting; arthritis; diabetes; epilepsy; heart problems; asthma; depression; detached retina/other eye problems; recent fractures/sprains; recent operations; back problems; knee problems; neck problems; recent pregnancies; if you are you pregnant; or anything else that may affect your ability to participate safely.
Inform the teacher if you are a beginner / need any support before you start the session;
Avoid the use of blades, weapons or sharp instruments of any description;
Avoid physical contact with other participants and where appropriate, adhere to social distancing guidelines;
Ensure that you have sufficient suitability to participate in these classes and choose those classes best suited to your ability.
4. FACE TO FACE YOGA SESSIONS – INDOOR & OUTDOOR
From September 2020, we aim to provide face to face yoga sessions in “facilities with multiple usage” in addition to regular outdoor yoga sessions.
All classes must be pre-booked and pre-paid for in advance on our website or via the GOTEAMUP app.
It is your responsibility to ensure that you have made your booking and submitted payment correctly.
If you have a 4 class in 4 week membership or single class pass, online booking automatically deducts a class from the pack.
If an unlimited monthly member, all classes included in your chosen membership type will have no cost attributed to them.
Please ensure that you have the correct payment option ONLINE, OUTDOOR OR FACE TO FACE when booking on to your class.
Additional workshops / courses must be paid for at the time of booking.
4.1 FACE TO FACE SERVICES HEALTH & SAFETY
A full risk assessment has been completed by Yoga 108 for classes.
Each venue has their own increased cleaning in operation and hand sanitisers at the entrance/exit. Yoga 108 will also have a supply of hand sanitiser and will clean touch points at the venue/in the studio before and after the class. Increased hand washing is encouraged.
Face masks must be worn in all venues when clients are not on their mat (unless exempt). From 24 September, organised indoor sport and indoor exercise classes can continue to take place with larger numbers present, provided groups of more than six do not mix. If groups of six are likely to mix, these indoor activities must not go ahead. Clients are asked to adhere to social distancing measures AT ALL TIMES. This includes:
Arriving no more than 5-10 minutes before the class to avoid mingling outside venue before – and after – the activity.
Enter the venue separately adhering to social distancing rules.
Latecomers will not be admitted.
Increase ventilation by keeping doors and windows open where possible and running ventilation systems at all times.
Maximum occupancy will be limited by providing a minimum of 100 square feet per person – Floor markings will be given to ensure this.
Yoga 108 will be taking part in the NHS Test and Trace by keeping a record of all clients for 21 days, as enforced by law. Some exemptions apply.
Clients are asked not to attend any class or event provided by Yoga 108 if they have symptoms of COVID-19, they will be asked to return home & self isolate and will not be permitted to enter.
If a teacher (or someone in their household) or a customer has a persistent cough, a high temperature or has lost their sense of taste or smell, they will isolate.
Clients to arrive dressed for practice and to leave coats, shoes and belongings near the entrance/exit of venue. Clients to bring own yoga mat & any props they may need (no mats or props will be available for use at this time). Sanitiser spray will be available to clean mats & the area surrounding the mat before leaving the venue.
The bathroom and coat hangers / shoe storage will be available to use.
Teacher will have own hand sanitiser, will remain 2 metres away from the students and will not be administering any hands on adjustments.
5. PRIVATE YOGA SESSIONS

A free consultation will be given to meet your personal requirements and agree a location – either online, at your own home, at Yoga 108, Billericay or an alternative agreed space.
All sessions must be pre-booked and pre-paid for in advance on our website via the GOTEAMUP app, or by emailing email@example.com.
5.1 PRIVATE YOGA SERVICES HEALTH & SAFETY
We require you to maintain social distancing at all times; regardless of outdoor or indoor sessions.
To ensure your safety, and that of our teachers and other students, please sanitise your hands on entry to any location used by Yoga 108 for classes.
For indoor sessions, please wear a mask at all times when you are not on your yoga mat and refrain from wandering around any facility used by Yoga 108 to provide yoga sessions.
Please arrive at any location used by Yoga 108 to provide Yoga classes dressed for practice & place your mat down at least 2 metres away from other practitioners/teachers in all directions.
Please bring your own yoga mat and any props you may need. No mats or props will be available for use at this time.
Teachers will not be providing hands on adjustments at this time.
6. CANCELLATION POLICY
We operate a cancellation policy for ALL classes – the following terms apply if not cancelled within the said notice period.
•Single classes, 4 classes in 4 weeks membership & class packs – you will be charged full price for the class or it will be removed from your class pass
•Introductory Offers and Unlimited Memberships – you will be automatically charged a no-show fee of £5.
Online Classes – Once confirmed, your space needs to be cancelled with 6 hours notice otherwise the above terms apply.
Face to Face Outdoor & Indoor sessions – As space is limited, once confirmed, your space needs to be cancelled with 24 hours notice otherwise the above terms apply.
Private Bookings – No refunds will be given if your session is cancelled within 24 hours.
Courses and workshops – Once purchased, you have committed to the payment and no refunds /transfers will be granted.
7. IF YOGA 108 CHANGES OR CANCELS YOUR BOOKING
We reserve the right to cancel a class that you have booked and make schedule changes at short notice. If a teacher becomes unavailable we will ensure – where practically possible – that they are replaced by another teacher.
If adverse weather means that the class has to be cancelled or the required minimum participants hasn’t been reached (3 participants), your payment can be transferred to the next convenient date for you or refunded.
We reserve the right to change the teacher taking the class you have booked onto. Where this is not possible, or where a session is cancelled due to unforeseen circumstances, we will credit your account with the price of the cancelled class or if you have a class pack we will credit your membership with the pass for the cancelled session to rebook on to an alternative class. For members, as there are no cost attributed for classes, you can rebook on to an alternative class.
YOGA 108 will not be liable for any other incurred costs or damages caused to you from a cancellation.
8. CHANGES OF PRICING
We reserve the right to review and change the price of our classes and memberships at our sole and absolute discretion.
Your monthly Membership Fees will remain the same as your Membership start date throughout your contracted period. Once your contract period has come to an end the Membership Fee will be charged at the rate at the time of the renewal.
9. PAYMENT OF CLASSES
When you sign up online for our 4-weekly contract or unlimited monthly membership, you will pay for your first months’ membership up-front by debit card or credit card and the following payments will be taken automatically.
Your membership fees will be payable every 4 weeks or month of your contract period and will become due 4 weeks or every month from when you purchased your membership. Your membership fees will then be payable every 4 weeks or every month of your contract period.
If your Membership Fees become overdue, we reserve the right to refuse you entry into our Studio/classes/courses/workshops until the overdue sums are paid in full.
Should you default on payments to us, we reserve the right to notify the default to a credit reference agency or other third party to obtain payment from you.
Payment can also be made via bank transfer at the Owners discretion to pre-book your yoga class/session.
10. CANCELLATION OF MEMBERSHIP
Monthly unlimited membership & 4 weekly mini-membership: can be cancelled after the initial 2 months minimum term with 7 days notice by emailing firstname.lastname@example.org. Should you advise of cancellation within 7 days of your next payment, you will be charged. No refunds/transfers will be given mid-term of membership.
Should you wish to hold your membership, please email Nathalie directly via email@example.com.
Once terminated, you can no longer participate in YOGA 108 with that membership and would need to purchase an alternative method. Full details here: www.yoga108.live.
11. FITNESS & HEALTH – FURTHER INFORMATION
We ask that you only attend a facility used by Yoga 108 to provide classes, events if you feel well. If you are unwell or showing any symptoms of Coronavirus, please do not attend any session provided by Yoga 108.
All customers participate in any activities delivered by YOGA 108 at their own risk.
All customers must inform their teacher and the Studio (firstname.lastname@example.org) of any injuries, disabilities or issues that may affect their ability to participate in activities.
We advise all customers not to take part in one of the classes/courses/workshops without first seeking medical advice if you/they have any concerns at all over their physical condition. You use any facilities used by Yoga 108 and take part in any of our services at your own risk.
If you have low/high blood pressure and/or cardiac irregularities – you should not attend class until you have written permission from your doctor. If there is any doubt, you should consult your doctor.
You must notify YOGA 108 of any circumstances affecting your health, which may be exacerbated through continued classes.
If you are pregnant, you must advise the teacher and be aware that if you are in the first trimester, you are not able to take classes. After 12 weeks, you can attend classes entirely at the individual teacher’s discretion. If the teacher agrees to you participating in class, this is at your own risk.
We reserve the right to refuse access to you or any customer if we in any way doubt your health and their ability to safely take part in the classes.
By attending classes/courses/workshops you accept the risk of injury from performing any exercises in the Studio.
YOGA 108 accepts no liability for injury to the customer, except in so far as such injury is by law incapable of exclusion.
By booking with us, all customers adhere to these full terms and conditions, which waive YOGA 108 responsibility for physical injury cause by any class/course/workshop provided by Yoga 108.
All customers will be asked to sign the Waiver via GOTEAMUP when creating their account, which outlines these terms and conditions waiving the studio of any injury caused by participating in activities at the studio. Alternatively, you may be asked to complete a Par-Q form prior to your session.
12. LITTLE YOGIS
Little Yogis will be returning with Nathalie later in 2020.
Booking our Little Yogis (4-11yrs) and Teen Yoga classes (for under 18s) means you and the participant adhere to our full terms and conditions. Booking means you / your child has permission to attend a yoga class at YOGA108.
The parent / guardian must inform the teacher and the Studio manager (email@example.com) of any injuries, issues, disabilities or sensitivities that may affect their ability to participate in activities.
Your child / teenager is participating in classes that requires physical exertion, which may be strenuous, and you are fully aware of the risks and hazards involved. You understand that it is your responsibility to ensure your child is fit and healthy to attend.
You represent and warrant that your child has no medical condition that would prevent her/his participation in physical fitness activities.
In consideration of being permitted to participate in the yoga classes, you agree to assume full responsibility for any risks, injuries or damages, known and unknown, which your child might incur as a result of participating. In further consideration of being permitted to participate in the yoga classes, you knowingly, voluntarily, and expressly waive any claim you may have against the instructor, the owner, or the leaseholder of the building for injuries or damages that my child may sustain as a result of participating in classes or workshops held at YOGA 108.
If your child participates in other future classes or events at YOGA 108 you will also assume full responsibility for any injuries that may result from her/his participation, with the same considerations that this waiver stipulates for yoga.
13. BOOKING FOR A THIRD PARTY
When booking for a friend or family member, each person needs to have their own registered account with GOTEAMUP. You can manage bookings for a third party, by adding them as a family member.
Booking for another person means that person adheres to our full waiver and terms and conditions.
14. PERSONAL BELONGINGS
Personal belongings brought to any place of teaching with Yoga 108 are at your own risk. The safety of your possessions are not the responsibility of YOGA 108. We do not accept liability for loss or damage of personal possessions except in so far as such loss or damage is by law incapable of exclusion. All lost and left property will be disposed of within 14 days.
We will compensate you for any loss or damage you may suffer as a result of a breach of the duties imposed on us by law. However, our liability to you may be mitigated to the extent the loss or damage is attributed to:
•your own fault;
•a third party unconnected with the provision of our services; or
•events which we could not have foreseen or avoided even if we had taken all of the responsible precautions our liability to compensate you (other than in the case of personal injury or death caused by our negligence) will be limited to £250 having regard to such factors as whether the loss of damage was due to a negligent act or omission by us.
Our liability to compensate you (other than in the case of personal injury or death) will be limited to a reasonable amount having regard to such factors as whether the loss or damage was due to a negligent act or omission by us.
By purchasing the membership and signing up to any of our classes at YOGA 108 – including Little Yogis, Teen Yoga, Events, Workshops and Courses – you agree to have your photograph taken and published for marketing purposes UNLESS specifically advised in writing to Nathalie at firstname.lastname@example.org.
17. FORCE MAJURE
We shall not be liable to you or deemed to be in breach of these terms by reason of any delay in performing or any failure to perform any of our obligations in relation to these Terms , if the delay was due to any cause beyond reasonable control, including, but not limited to, Acts of God, explosion, flood, storm, fire, war or threat of war, riot, sabotage, insurrection, civil disturbance, restrictions, regulations, by-laws, prohibitions or measures of any kind on the part of any government, parliamentary, or local authority, strikes, lockouts or other industrial action or trade disputes (whether involving our employees or those of any third party), I.T, viruses, difficulties in obtaining raw materials, labour, fuel, parts or machinery, power failure or breakdown in machinery.
No delay or failure by either party to exercise any of its powers, rights or remedies under these Terms will operate a waiver of them, nor will any single or partial exercise of any such powers, rights or remedies preclude any other or further exercise of them. Any waiver to be effective must be in writing.
If any part of these Terms is found by a court of competent jurisdiction or other competent authority to be invalid, unlawful or unenforceable then such part will be severed from these Terms, the remainder of which will continue to be valid and enforceable to the fullest extent permitted by law.
20. DATA PROTECTION
We, YOGA 108, will use your personal details and information to provide you with use of our services and facilities, to administer and maintain our membership records, to process your application and payments, to verify your identity and to carry out market research. We may keep your information for a reasonable period for these purposes. We may share your information with our service providers in order to provide you with services, and with other third parties to comply with our legal or regulatory obligations, for the prevention of fraud or other crimes, and in the case of medical emergencies. If your personal details change, if you change your mind about how you wish to be contacted, or if you have any queries about how we use your information, please let us know by contacting email@example.com. You hereby consent to the use of your information, including sensitive personal data relating to your health and fitness, for the reasons and in the manner set out above.
